Terms of Service

Booking & Payments

• Advance Payment: A minimum advance of 15% of the total agreed fee is required to confirm and lock your event date. Without this advance, your date is not secured.
• Payment Schedule: Further payments are made at mutually agreed milestones — typically on site visit, on the event day, and upon delivery of final deliverables.
• Online Payments: AI Photo Plans and Cloud Storage Plans purchased through our website are processed securely via Razorpay. Plans are activated only after successful payment confirmation.
• Full Settlement: Final deliverables — including high-resolution photo collections, edited video footage, and custom songs — are released only after 100% payment is received and cleared.
• Receipts: All Razorpay transactions generate a digital receipt automatically. For cash or bank transfers, a manual receipt is issued upon request.

AI Photo Gallery & Guest Use

instantpik uses Amazon Rekognition to identify guests in event photos based on a selfie or uploaded photo. By using the gallery search, guests agree to the following:

• Guests must provide a valid 10-digit Indian mobile number (WhatsApp-enabled) to access their personal gallery.
• The AI face-matching system operates at a similarity threshold tuned per search. Results may occasionally miss photos taken in poor lighting, unusual angles, or heavy makeup.
• Each guest's gallery shows only photos containing their own face — other guests' photos are never visible to them.
• Guests may download full-resolution photos from their personal gallery for personal, non-commercial use only.
• Sharing, selling, or commercially exploiting event photos without written permission from instantpik and the event client is strictly prohibited.
• Gallery links shared via WhatsApp are personal — guests are responsible for not sharing their link with others outside their family.

Cloud Storage Plans

All event photos are stored on Amazon S3 and delivered to guests via CloudFront CDN. The following plan terms apply:

• Storage plans are activated from the date the event is created in our system — not from the event date itself.
• Photos exceeding the plan's storage limit will not be uploaded until additional storage is purchased.
• After the gallery access period expires, photos are archived. Retrieval after expiry may incur additional charges.
• Unused storage credits may be transferred to a future event within 12 months upon written request.
• We maintain automated daily backups on AWS S3 to minimise data loss risk.

Data, Selfies & Privacy

• Selfie Data: Selfies and uploaded photos are used solely for AI face-matching. They are stored temporarily on our server and automatically deleted within 24 hours by our scheduled cleanup system.
• Phone Numbers: Guest phone numbers are used only to link gallery results and deliver the WhatsApp gallery link. They are never sold, shared, or used for marketing without consent.
• Event Photos: Event photos are stored on Amazon S3 in a private bucket accessible only via signed CloudFront URLs. They are never publicly indexed or accessible without the event code.
• Biometric Consent: By using the AI selfie search, guests consent to temporary biometric processing (face comparison) for the sole purpose of photo delivery. No biometric data is retained beyond the selfie cleanup window.
• Minor Guests: If guests below 18 years of age use the selfie search, it is assumed that a parent or guardian has provided consent on their behalf.

Intellectual Property

• Photographer's Copyright: instantpik retains copyright to all photographs and videos captured at your event unless a separate written copyright-transfer agreement is signed.
• Client Licence: Upon full payment, clients receive a personal, non-commercial licence to use, print, and share their event photos. Commercial use requires a separate written agreement.
• Portfolio Rights: We reserve the right to use select photos from your event in our portfolio, website, and social media, unless you explicitly request otherwise in writing before the event.
• Platform & Software: The instantpik platform, AI delivery system, QR codes, and all related software are proprietary to instantpik. Reverse-engineering, scraping, or copying any part of our system is prohibited.
• Custom Music: Songs composed under Fab Musicals are commissioned works. Upon full payment, you own the composition for personal use. Broadcast or commercial licensing requires a separate agreement.

Limitation of Liability

• We are not liable for loss or corruption of photos due to equipment failure, power outages, natural disasters, or circumstances entirely beyond our reasonable control.
• We maintain automated AWS S3 backups to minimise data loss, but cannot guarantee full recovery in the event of catastrophic failure.
• Our maximum liability in any claim shall not exceed the total fee paid for the specific service in dispute.
• We are not responsible for poor AI matching results caused by extremely blurry selfies, face-obstructing accessories, or event photos taken in near-darkness.
• We are not responsible for the behaviour of venue staff, guests, or third parties that interfere with our equipment or operations.

Cancellation & Refund Policy

• Client Cancellation: Advance payments are non-refundable. The advance confirms your booking and prevents us from accepting other clients for that date.
• Rescheduling: One rescheduling request with a minimum of 14 days notice may be accommodated without penalty, subject to availability.
• Studio Cancellation: In the rare event we must cancel due to an emergency, a full refund of all amounts paid will be issued within 7 working days.
• AI & Storage Plans: Cloud Storage and AI Photo Plans are non-refundable once an event is activated. Unused credits may be transferred to a future event within 12 months upon written request.
• Disputes: Refund disputes are evaluated case-by-case. We commit to a fair, written resolution within 14 working days of receiving a formal request.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of East Godavari District, Andhra Pradesh.

By using any instantpik service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
